Liability Waiver

Please read this entire document carefully before signing. This is a legally binding agreement between you and JAM - WATER SPORTS LLC d/b/a RIDE THE WAKE.

1. Description of Activity

I understand that wakeboarding, water skiing, wake surfing, and related watersports ("Activities") involve inherent risks including but not limited to: collisions with other watercraft or objects, falls, submersion, rope entanglement, board impact, and unpredictable water and weather conditions. These risks can result in serious bodily injury, disability, or death.

2. Assumption of Risk

I voluntarily choose to participate in the Activities and acknowledge that I am fully aware of the risks involved. I assume full responsibility for any injury, loss, damage, or death that may occur as a result of my participation, whether caused by the negligence of JAM - WATER SPORTS LLC d/b/a RIDE THE WAKE, its employees, agents, or other participants, or otherwise.

3. Release of Liability

In consideration of being permitted to participate in the Activities, I hereby release, waive, discharge, and covenant not to sue RIDE Watersports, its owners, officers, employees, instructors, agents, volunteers, and representatives (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in the Activities or while on the premises of RIDE Watersports.

4. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to my participation in the Activities, whether caused by negligence of Released Parties or otherwise.

5. Medical Authorization

I authorize RIDE Watersports staff to seek emergency medical treatment on my behalf if I am incapacitated and unable to do so myself. I acknowledge that I am physically fit and have no medical conditions that would prevent me from safely participating in the Activities.

6. Rules & Safety

I agree to follow all safety instructions provided by RIDE Watersports staff, wear a Coast Guard-approved life jacket at all times while on the water, and adhere to all applicable federal, state, and local boating regulations. I understand that failure to comply may result in immediate termination of my session without refund.

7. Minors

If the participant is under 18 years of age, a parent or legal guardian must sign this waiver on their behalf. By signing, the parent/guardian agrees to all terms herein and accepts full responsibility for the minor's participation. Sessions with minors will not proceed without a signed guardian waiver.

8. Photography & Media

I grant JAM - WATER SPORTS LLC d/b/a RIDE THE WAKE permission to photograph or video record my session and use such media for promotional purposes on social media, website, or marketing materials, unless I explicitly opt out below.

9. Severability & Governing Law

If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect. This waiver shall be governed by the laws of the State of Florida. Any disputes shall be resolved in Miami-Dade County, Florida.
